Workers' Compensation
Texas Pool Contractor Workers' Compensation Insurance
Pool construction combines excavation, plumbing, electrical, and concrete work — several high-hazard trades under one contractor. Trench-collapse, electrical-shock, equipment, and chemical injuries are the top claims. Texas does not require workers' comp for private employers, but a pool shop without it puts the owner's personal assets behind every trench and electrical injury and locks the shop out of commercial work.
Trench and Excavation Exposure
Pool excavation is trench work. OSHA requires trench protection for any trench over five feet — sloping, shoring, or shielding. Documented trench-safety programs reduce both fatalities and the experience modifier. Carriers ask about trench-safety programs; a documented program is a premium factor and a lifesaver.
Electrical-Shock and Chemical Exposure
Pool electrical — pumps, lighting, and bonding — is a shock and electrocution hazard. Pool chemicals — chlorine and acid — cause chemical burns and respiratory exposure. Lockout/tagout, bonding, and chemical-handling programs reduce both injuries and the experience modifier. Documented electrical and chemical-safety programs are premium factors.
Owner and Officer Coverage
Texas allows sole proprietors and officers to exclude themselves from workers' comp. Many pool owners include themselves because working owners operate equipment, work near trenches, and handle chemicals. An owner who excludes himself has no wage-loss or medical coverage for his own injury — and a pool electrical shock can be fatal.
Uninsured Subcontractor Exposure
If you use 1099 pool crews without workers' comp, an injured sub can bring a claim against your policy. Texas carriers charge uninsured subcontractor exposure at the pool rate at audit — among the higher construction rates. Requiring 1099 crews to carry their own workers' comp and name you additional insured removes the exposure and the premium.
