Workers' Compensation
Texas Roofing Contractor Workers' Compensation Insurance
Roofing has the highest fall-injury rate of any construction trade, and Texas heat compounds the danger. Workers' compensation for roofers is expensive and hard to place because carriers know the loss statistics — but operating without it is the single largest financial risk a Texas roofing contractor carries. One serious fall claim without coverage can generate a lawsuit with no damages cap and attach to the owner personally.
Does Texas Require Roofers to Carry Workers' Comp?
Texas does not mandate workers' comp for private employers. But every commercial GC, every production homebuilder, and most large residential project owners require a roofing sub to show a workers' comp certificate before mobilization. A roofing contractor without workers' comp is effectively limited to small cash residential jobs — and even there, an injury is an uninsured catastrophe.
Owner Exclusion for Sole-Proprietor Roofers
A sole proprietor with no employees can often exclude themselves from workers' comp, lowering premium substantially. The trade-off: if you fall off a roof, your medical bills and lost income are not covered by the policy. Many owner-operators include themselves for the medical-only protection and to satisfy GCs who want the principal covered. Decide deliberately, not by default.
Heat Illness and Texas Roofing
Texas summers make heat illness a top roofing claim. OSHA does not have a specific heat standard yet, but a heat-illness claim that sends a roofer to the ER is a workers' comp claim, and repeated heat claims drive your experience modifier up. Documented hydration and shade programs reduce both injuries and premium.
Uninsured Subcontractor Risk
If you use 1099 roofing crews who carry no workers' comp, an injured sub-roofer can bring a claim against your policy. Texas carriers charge uninsured subcontractor exposure at the roofing rate at audit — the most expensive rate on the policy. Requiring every 1099 crew to carry their own workers' comp and name you additional insured removes that exposure and that premium.
