Workers' Compensation

Texas Flooring Contractor Workers' Compensation Insurance

6 min read FlooringUpdated July 2026

Flooring is a knee-heavy, chemical-exposed trade. Crews install on their knees, handle adhesives and finishes, and operate saws and cutters. Knee injuries, chemical exposure, and lacerations are the top claims. Texas does not require workers' comp for private employers, but a flooring shop without it puts the owner's personal assets behind every serious injury and locks the shop out of commercial work.

Knee and Back Injuries

Knee injuries from kneeling and back injuries from lifting flooring rolls and tile pallets are the most frequent flooring claims. Knee pads, mechanical lifts, and team-lift protocols reduce frequency. Even frequent lower-severity claims drive the experience modifier up over time.

Adhesive and Finish Chemical Exposure

Flooring adhesives, epoxy, and finishes produce respiratory and skin exposure. Ventilation, respirator programs, and hazard-communication training reduce both injuries and the experience modifier. Documented chemical-safety programs are a premium factor for epoxy and resinous flooring shops.

Owner and Officer Coverage

Texas allows sole proprietors and officers to exclude themselves from workers' comp. Many flooring owners include themselves because working owners face the same knee, chemical, and saw exposures. An owner who excludes himself has no wage-loss or medical coverage for his own injury.

Uninsured Subcontractor Exposure

If you use 1099 flooring crews without workers' comp, an injured sub can bring a claim against your policy. Texas carriers charge uninsured subcontractor exposure at the flooring rate at audit. Requiring 1099 crews to carry their own workers' comp and name you additional insured removes the exposure and the premium.

What Commercial GCs Require

  • Workers' comp with statutory Texas benefits and employer liability of $1M/$1M/$1M
  • Waiver of subrogation in favor of the GC and owner
  • Coverage continuing through flooring closeout and inspection
  • Certificate delivered before the sub mobilizes
