Workers' Compensation
Texas Tree Trimming Contractor Workers' Compensation Insurance
Tree trimming has the highest fatal fall rate in construction. Falls from trees, chipper injuries, saw lacerations, and power-line electrocution are the top claims — and tree falls are frequently fatal. Texas does not require workers' comp for private employers, but a tree shop without it puts the owner's personal assets behind every fall and electrocution and locks the shop out of commercial and utility work.
Fall Exposure from Trees
Falls from trees are the signature fatal tree-trimming claim. Climbing and aerial-lift fall-protection programs, lifelines, and lift certification reduce both fatalities and the experience modifier. Carriers ask about fall-protection programs; a documented program is a premium factor and a lifesaver.
Chipper, Saw, and Electrocution Exposure
Chippers produce caught-between and amputation injuries. Chainsaws produce lacerations. Power-line contact produces electrocution — a fatal claim. Chipper-guard protocols, two-person chipper operation, and line-clearance certification reduce both injuries and the experience modifier. Documented chipper and line-clearance programs are premium factors.
Owner and Officer Coverage
Texas allows sole proprietors and officers to exclude themselves from workers' comp. Many tree owners include themselves because working owners climb, operate chippers, and work near power lines. An owner who excludes himself has no wage-loss or medical coverage for his own injury — and a working-owner tree fall can be fatal and end the business.
Uninsured Subcontractor Exposure
If you use 1099 tree crews without workers' comp, an injured sub can bring a claim against your policy. Texas carriers charge uninsured subcontractor exposure at the tree-trimming rate at audit — among the highest construction rates. Requiring 1099 crews to carry their own workers' comp and name you additional insured removes the exposure and the premium.
