Texas Insurance Compliance
Texas Landscaping Contractor Insurance Requirements
Landscaping contractors in Texas work across residential maintenance, commercial groundskeeping, hardscape installation, and chemical application. Each line carries different risk, and a generic "landscaping" policy often misses the one that matters most to your operation. Insurance for landscapers has to account for property damage from equipment, chemical drift from fertilizer and pesticide application, and the workers who operate mowers, trimmers, and loaders in Texas heat.
General Liability for Landscaping Contractors
GL for landscapers centers on property damage — a thrown rock from a mower, a damaged sprinkler line, or a chemical burn from a misapplied herbicide. Standard limits start at $1M per occurrence / $2M aggregate for residential and commercial HOA work. If you apply pesticides or herbicides commercially, verify your GL covers chemical application; many standard policies exclude it or require a separate pollution endorsement. Hardscape and irrigation installation add completed-operations exposure for retaining walls and water features.
Chemical Application & Pollution Exposure
Fertilizer, herbicide, and pesticide application can cause chemical drift onto neighboring property or contamination. Standard GL excludes most pollution and chemical-drift claims. If chemical application is a meaningful part of your revenue, a limited pollution liability endorsement or a separate applicator policy is essential. Texas requires a pesticide applicator license from the Texas Department of Agriculture for commercial application — uninsured, unlicensed application is a claim carrier that will deny.
Workers' Comp for Landscaping Crews
Landscaping crews operate mowers, trimmers, blowers, and small loaders in Texas heat. Debris-strike injuries, heat illness, and equipment lacerations are the top claims. Texas doesn't require workers' comp for private employers, but commercial clients and HOAs increasingly require it before awarding maintenance contracts. Without workers' comp, a single heat-illness or equipment injury is an uninsured event against the owner personally.
Tools & Equipment (Inland Marine)
Landscaping equipment — commercial mowers, zero-turns, trimmers, blowers, and small loaders — is expensive and frequently left on trailers and job sites. Inland marine coverage protects against theft, the most common landscaping loss. Verify coverage extends to equipment on trailers and at job sites, and that per-item limits cover your most expensive mowers and loaders.
Commercial Auto for Landscaping Trucks and Trailers
Landscaping trucks towing loaded trailers are a daily exposure. A loaded trailer accident can exceed Texas minimum auto limits of $30K/$60K/$25K. Carry commercial auto with adequate limits and verify trailer and trailer-interchange coverage if you swap trailers. Add hired and non-owned for crew using personal vehicles for work errands.
What HOAs and Commercial Clients Require
- General Liability with $1M/$2M minimum
- Workers' Compensation with employer liability
- Additional Insured endorsement on the policy
- Waiver of subrogation in favor of the HOA or property owner
- Certificate of Insurance before contract activation
