Workers' Compensation
Texas Excavation Contractor Workers' Compensation Insurance
Excavation is the most dangerous trade for fatal injuries. Trench collapses, heavy-equipment incidents, and struck-by injuries are the top claims — and trench collapses are frequently fatal. Texas does not require workers' comp for private employers, but an excavation shop without it puts the owner's personal assets behind every trench collapse and locks the shop out of commercial and DOT work.
Trench-Collapse Exposure
Trench collapses are the signature fatal excavation claim. OSHA requires trench protection for any trench over five feet — sloping, shoring, or shielding. Documented trench-safety programs reduce both fatalities and the experience modifier. Carriers ask about trench-safety programs; a documented program is a premium factor and a lifesaver.
Heavy-Equipment and Struck-By Injuries
Excavators, loaders, and dump trucks produce struck-by and caught-between injuries. Equipment-operator certification, spotter protocols, and ground-worker exclusion zones reduce frequency and severity. Even frequent lower-severity claims drive the experience modifier up over time.
Owner and Officer Coverage
Texas allows sole proprietors and officers to exclude themselves from workers' comp. Many excavation owners include themselves because working owners operate equipment and work near trenches. An owner who excludes himself has no wage-loss or medical coverage for his own injury — and a self-operated trench collapse can end the business.
Uninsured Subcontractor Exposure
If you use 1099 excavation crews without workers' comp, an injured sub can bring a claim against your policy. Texas carriers charge uninsured subcontractor exposure at the excavation rate at audit — among the highest rates. Requiring 1099 crews to carry their own workers' comp and name you additional insured removes the exposure and the premium.
